What is a Thailand Marriage Visa?

The Thailand Marriage Visa, also known as the Non-Immigrant O Marriage Visa is designed specifically for foreigners who are married to Thai nationals. This visa allows you to legally stay in Thailand for up to one year, with the option to renew annually. Unlike a tourist visa, it offers long term security, the ability to apply for a work permit and a clear route toward permanent residency if you wish to stay long term.

Who Qualifies for a Marriage Visa?

To be eligible, you must be legally married to a Thai national. You also need to meet financial requirements to prove you can support yourself while living in Thailand. This can be done in one of three ways:

  • Maintaining a bank deposit of at least 400,000 THB in a Thai bank account for at least three months before applying.
  • Showing proof of a monthly income or pension of at least 40,000 THB, verified by your home country’s embassy.
  • A combination of both savings and income that totals at least 400,000 THB per year.

In addition to financial proof, applicants must provide a valid passport, recent passport sized photos, and completed visa application forms. You will also need to submit supporting documents that include evidence of your spouse’s Thai nationality, such as their Thai ID card and House Registration Book, your marriage certificate, and a family photo together with your spouse (and children, if applicable).

Siam GP law firm can guide you through every document requirement, including maps of your residence, embassy letters verifying income or Thai bank letters confirming deposits. If any documents are not in Thai or English, we will help you get them translated and notarised according to immigration requirements.

How Long Does the Visa Last and What Are the Benefits?

Once approved, the marriage visa allows you to stay in Thailand for 12 months. The visa can be renewed indefinitely as long as you continue to meet the financial requirements. Unlike a retirement visa , the marriage visa also allows you to apply for a Thai work permit, giving you the freedom to work legally in Thailand.

Other benefits include the ability to travel in and out of Thailand with a re-entry permit and a structured pathway toward permanent residency if you choose to make Thailand your long term home.

Marriage Visa Obligations

After receiving your Thai marriage visa, there are a few responsibilities you need to follow. First, you must report your current address to immigration every 90 days. This can be done in person, by mail or online, and our team can handle this reporting for you if needed.

If you plan to leave Thailand during your visa validity, a re-entry permit is required to ensure your visa remains valid. The visa can be renewed inside Thailand, but your Thai bank account balance must have been maintained for at least three months prior to renewal.

It’s important to note that if your marriage ends in divorce, the visa becomes invalid and you may be required to leave the country immediately. However, in some cases you may be allowed to remain until your current visa expires.

The Application Process

Applying for a marriage visa usually begins with obtaining a 90 Day Non-Immigrant O Visa. This visa can be obtained at a Thai Embassy or Consulate in your home country, or in nearby countries if more convenient. Once in Thailand, you will prepare all required documents for converting your Non-Immigrant O Visa into a one year marriage visa. This application should ideally be submitted during the last 30 days of your 90 day permit.

For those already in Thailand on a tourist visa or visa exemption, it is still possible to apply for a marriage visa as long as you meet the eligibility criteria. The process involves submitting all required documents to the local immigration office where you reside with your Thai spouse.
